This is the Privacy Policy of  monoforest. and aaChat (collectively hereinafter, “Chat”, “us”, “we”, or “our”) and is incorporated into and is subject to our Terms of Use which can be found at https://aachat-333777.web.app/privacy.html In this Privacy Policy, we refer to our products and services as the “Service.” Please read on to learn more about our data handling practices. Your use of the Service signifies that you agree with the terms of this Privacy Policy. If you do not agree with the terms of this Privacy Policy, do not use the Service.

Information we collect

When you install the Service on your device and register with Chat, personally identifiable information about you may be collected during the download process for the Service (as requested from you during the download process) when you register with us.

Chat may also collect and gather non-personally identifiable information, such as certain profile information including country of residence and preferences. In addition, Chat may collect and store information about your and others’ usage of and interaction with the Service and our websites, including matches, numbers of matches made by members, match durations, text messages, usage by geographies, device and connection information, IP address, device capability, bandwidth, statistics on page views, network type and traffic to and from our websites.

Chat allows you to share text messages, photos, screenshots, videos and other communications in the Chat application with other users, and if you choose to do so your text messages, photos, screenshots, videos and other communications will be stored on our servers. In addition, if you choose to share these items with other Chat users, we may not be able to remove them from our servers or make them unavailable to anyone you have shared them with. Sending and sharing text messages, photos, screenshots, videos or other communications in the Chat application is your decision. By choosing to share that information, you should understand that you may no longer be able to control how that information is used and that it may become publicly available (depending in part on your actions or the actions of others with whom you have shared the information). Chat is not responsible for any use or misuse of information you share.

Chat may also collect and gather user contents (e.g., photos, screenshots, comments, and other materials) that you create on the Service. Your photo can be taken by other users on the Chat, and If they use capturing function provided by the Chat, those photos can be stored and used for Chat and 3rd party’s service(eg, Facebook, etc.). You can change sharing option of 3rd party on the Chat settings. If you do not agree with all the terms of this Privacy Policy, do not use the Service.

To complete a commerce transaction on Chat item shop, you will be requested to provide your payment information, including your credit card number, card expiration date, CVV code, and billing address. In that event, we will transmit your information securely directly to a third party vendor or merchant who will collect such information in order to process and fulfill your purchase. Chat does not process or store your payment information. However, we may store other information about your purchases made on the Service, which may include the merchant’s name, the date, time and amount of the transaction and other behavioral information.

To complete a SMS authentication on Chat, you will be requested to provide your phone number. Your phone number is not share with other users and is not use for purposes other than SMS authentication. In that event, we will transmit your information securely directly to a third party vendor who will collect such information in order to process and fulfill your SMS authentication.

We also collect error-reporting information if the Service crashes or hangs up so that we can investigate the error and improve the stability of the Service for future releases. In general these reports do not contain personally identifiable information, or only incidentally. As part of these error reports, we receive information about the type and version of your device, the device identifier, the time the error occurred, the feature being used and the state of the application when the error occurred. We do not use this information for any purpose other than investigating and fixing the error.

Sharing of your information

We will not rent or sell your information to third parties (or the group of companies of which Chat is a part) without your consent, except as noted in this Policy.

Parties with whom we may share your information:

● We may share User Content and your information (including but not limited to, information from cookies, log files, device identifiers, location data, and usage data) with businesses that are legally part of the same group of companies that Chat is part of, or that become part of that group ("Affiliates"). Affiliates may use this information to help provide, understand, and improve the Service (including by providing analytics) and Affiliates' own services (including by providing you with better and more relevant experiences). But these Affiliates will honor the choices you make about who can see your contents.

● We also may share your information as well as information from tools like cookies, log files, and device identifiers and location data, with third-party organizations that help us provide the Service to you ("Service Providers"). Our Service Providers will be given access to your information as is reasonably necessary to provide the Service under reasonable confidentiality terms.

● We may also share aggregate or anonymous information with third parties, including advertisers and investors. For example, we may tell our advertisers the number of users our app receives. This information does not contain any personal or personally identifiable information, and is used to develop content and services that we hope you will find of interest.

● We may remove parts of data that can identify you and share anonymized data with other parties. We may also combine your information with other information in a way that it is no longer associated with you and share that aggregated information.

Parties with whom you may choose to share your User Content:

● Any information or content that you voluntarily disclose for posting to the Service, such as User Content, becomes available to the public. With this feature, Chat can be protected from exhibitionism. Once you have shared User Content or made it public, that User Content may be re-shared by others.

● If you remove information and contents(eg. Screenshots, etc.) that you created on the Service, copies may remain viewable in cached and archived pages of the Service, or if other Users or third parties have copied or saved that information.(eg. Facebook, etc.)

Location-based service terms and conditions

Perpose

These location-based service terms and conditions (hereinafter referred to as “these terms and conditions”) refer to the location-based services (hereinafter referred to as “services”) provided by monoforest. (hereinafter referred to as the “company”) within the Chat mobile application (hereinafter referred to as “app”) The purpose of this is to prescribe basic matters such as rights and obligations between the company and you (hereinafter referred to as “users”) who are the subject of location information, as well as conditions and procedures for use.

Effect and Change of Terms and Conditions

● These terms and conditions become effective when the user agrees to these terms and conditions and agrees to use the service according to the procedures set by the company.

● The company may modify these terms and conditions for the purpose of reflecting changes in laws or services.

● If these terms and conditions are changed, the company will notify the user of the change at least 7 days in advance through the app or individually.

● However, if the revised content causes a significant change to the user's rights, the change will be posted 30 days in advance.

Rules other than the terms and conditions

For matters not specified in these Terms and Conditions, the relevant laws and regulations such as the Act on the Protection and Use of Location Information, the Telecommunications Business Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. and the guidelines set by the company shall be followed.

Service Use Agreement Procedure

● Consent to use of the service is established when the user expresses his/her intention to consent in accordance with the procedure provided by the company when registering as a member after installing the app on the user's terminal device.

● Even if you agree to the use of the service, you can use the service only if you activate the GPS location information reception function of your mobile device.

● If the user does not agree to these terms and conditions, the use of the service may be restricted.

Content of Service

The company provides the following services based on the user's location information.

● Apps to which the service is applied: Chat

● Service contents: After confirming the user's location, among a plurality of users who use the service, it is recommended, viewed, or linked as a conversation partner among users located in a short distance. Provides

Suspension of Service Provision

● The service may be suspended for operational or technical reasons of the company. In this case, the company will notify it without delay in advance or after the fact in unavoidable cases.

● The Company shall provide services in the event of war, incident, natural disaster, or a national emergency equivalent thereto, or if there are other unavoidable reasons such as suspension of telecommunication service by the key telecommunication business operator according to the Telecommunications Business Act. ● The company does not take any responsibility if the service is restricted or suspended according to paragraphs 1 and 2.

Restrictions on users' use, etc.

The company may restrict the use of all or part of the service without the user's consent in the following cases.

● When the user plans or executes the use of the service for a purpose or method that violates social norms such as laws, public order, morals, customs, etc.

● When the user violates the terms of use of the app or the provisions of these terms

● Users If there is a risk of causing or causing significant disruption to the company's business performance or computer system

Service usage fee

● The service fee does not occur if the company does not notify otherwise.

● However, if the user uses the communication network to use the service, communication charges to be paid to the mobile communication service provider may be incurred in connection with the use of the communication network.

Use or Provision of Location Information

● The company does not use the user's location information except as specified in these terms and conditions.

● The company does not provide the user's location information to a third party, and in the case of providing it to a third party, the recipient and the purpose of the provision are notified to the user in advance.

● The company may provide the user's location information to the relevant investigation agency if there is a request from the investigation agency in relation to the crime.

● The company automatically records and preserves data confirming the collection, use, and provision of personal location information in accordance with Article 16, Paragraph 2 of the Act on the Protection and Use of Location Information, and the data will be deleted by the user from the Chat member. It is stored until one year has elapsed from the date it was made. If the user has not withdrawn from membership but has not used Chat for a long time, the relevant data will be kept until one year has elapsed from the date the user last used Chat.

Rights of Users

● The user may stop providing location information at any time by disabling the GPS reception function of the mobile terminal device.

● In order to withdraw consent to the collection and use of location information, the user must individually make a request to the contact information listed in Article 18 of these Terms of Use or withdraw from the Chat member.

● Users may request the company to read or notify the following materials, and if there are errors in the materials, they may request corrections. In this case, the company will not reject the request without justifiable reasons.

1) Information stored by the company about the user's own location information

2) The reason and content of the user's location information provided to a third party in accordance with the Act on the Protection and Use of Location Information or other laws Exceptions are made in cases where the information is provided to investigative agencies)

● When a user withdraws his/her consent to the use and provision of location information, the company destroys the user's location information stored by the company without delay unless there are special circumstances.

● The user may request the company through the company's prescribed procedures to exercise the rights

Restrictions on Age for Service Use

The company may restrict the use of all or part of the service without the user's consent in the following cases.

Obligations of the company

● If the company recognizes that the opinions or complaints raised by users are justified, they must be dealt with immediately. However, if immediate processing is difficult, the user must be notified of the reason and processing schedule by e-mail, etc.

● The company cannot disclose or distribute the user's location information acquired in connection with the provision of the service to a third party without prior consent of the user. However, exceptions are made when a request is made by an investigation agency for the purpose of investigation under the relevant laws and regulations.

● In order to provide continuous and stable service, the company will repair or restore the equipment without delay when it is damaged or lost.

Obligations of Users

● Users must not engage in any of the following acts when using the service.

1) Acts of duplicating or commercial use of location information obtained using the company's services without prior consent of the company

2) Acts that intentionally interfere with service operation or may interfere with the stable operation of services

3) Collect location information of others , storage, use, or disclosure

4) Using the location information of the user or others to give property benefits to themselves or others, cause damage to others, damage the reputation of others, or disadvantage others

5) Acts of collecting, storing, using, or disclosing location information by impersonating or impersonating an employee or operator of the company or by stealing the name of another person

6) Other illegal or unfair acts

● Users must comply with relevant laws and regulations You must comply with the provisions of the Terms and Conditions, the notices notified by the company, and the matters notified by the company, and you must not engage in any other acts that interfere with the business of the company.

● The company may restrict or suspend the user's use of the service in the event of an act described in Paragraph 1 or Paragraph 2 of this Article.

Scope of Compensation for Damage

● The user may claim damages from the company if the company has suffered damages due to an act in violation of Articles 15 to 26 of the Act on the Protection and Use of Location Information.

● The company does not compensate for damages caused by force majeure, such as natural disasters, or due to the user's intention or negligence.

● The company does not compensate for damages suffered by users and third parties as a result of the user using error or inaccurate location information depending on the communication environment of the network operator or mobile communication operator.

● The user shall be liable for any damages suffered by the company due to the violation of the provisions of these terms, such as the user's obligations, even after the service use contract is terminated according to these terms and conditions.

Immunity

● The company shall not be held liable for any damages incurred by the user if the service cannot be provided due to any of the following cases.

1) When there is a natural disaster or a force majeure equivalent thereto

2) When there is a deliberate interference with the service by a third party that has entered into a service partnership contract with the company to provide the service

3) When there is a problem in using the service due to reasons attributable to the user

4) In the case of any other cause other than No. 1 through No. 3 without intention or negligence of the company Do not.

Mediation of Disputes and Others

● The company may apply for finance to the Korea Communications Commission in accordance with the provisions of Article 28 of the Act on the Protection and Use of Location Information in the event that the parties do not reach a consultation or are unable to agree on a dispute related to location information .

● The company and the user may apply for mediation to the Personal Information Dispute Mediation Committee pursuant to Article 40 of the Personal Information Protection Act if the parties cannot or cannot agree on a dispute related to location information.

● If a dispute is not resolved even by paragraphs 1 and 2 of this Article, all disputes related to these Terms and Conditions shall be resolved under the laws of the Republic of Korea, with the Seoul Central District Court as the exclusive jurisdiction of the first instance.

● For internal operations, including troubleshooting problems, data analysis, testing, research, improvements to the Service, detecting and protecting against error, fraud or other illegal activity;

● When we have a good faith belief that the law, any legal process, law enforcement, national security or issue of public importance requires disclosure;

● To protect and defend our rights or property (including to enforce our Terms of Use and other agreements); or

● In connection with a corporate transaction involving Chat, such as the purchase or sale of a business unit, an acquisition, merger, sale of assets, or other similar event.

Data Access and Removal

You can always control what information you choose to share with us on the Service. To do so, you can change your settings in the Service or in your mobile device. Alternatively, you can remove the Service from your mobile device entirely.

You can remove your data anytime you want. If you ask us to delete your account, we will use commercially reasonable efforts to remove your data from our servers.

Any personally identifiable information that (i) you share in text messages, photos, videos or otherwise in or through the Chat application with other users, or (ii) submit on a blog, bulletin board or chat room on our website or elsewhere, can be viewed and used by others, including to send you unsolicited messages or to commit identity theft. Chat is not responsible for any use or misuse of your information that might result from your disclosure of information.

Service Providers

In certain instances, monoforest. and Chat may have contracts with third parties to provide products and/or services in connection with the Service. In those cases, Chat may share your personal information with Chat’s third-party service providers, but only in connection with providing the services to you. For example, Chat shares your phone number or email with third party SMS and email providers to deliver the authentication SMS or email to you when you register with Chat. We contractually require that these third parties use your information solely to deliver SMS or email to you and to use appropriate security measures to protect your information. In addition, certain Chat servers are owned and hosted by third party service providers. This Privacy Policy does not apply to the practices of third party service providers.

Outbound Links

If you accessed a website, product or service provided by a third party, including through the Service or a Chat website, such third party may also collect information about you. Please see the privacy policies of each such third party for more information about how they use the information they collect. This Privacy Policy does not apply to any exchange of information between you and any third party.

Opt-Out – Promotional Communications

Chat allows you to choose not to receive promotional email messages from Chat and its service providers. You may opt-out by following instructions in the message sent by Chat or its service providers on how to unsubscribe from that particular mailing. You may also opt-out by contacting us at cs@monoforest.com.

Security

Protecting user privacy and personal information is a top priority for monoforest and Chat. We make substantial efforts to ensure the privacy of all personally identifiable information you provide to us. Access to all personally identifiable information is restricted to those monoforest and Chat employees, contractors, agents and third-party service providers who need to know that information in order to provide, operate, develop, maintain, support or improve the Service. monoforest and Chat uses password protection, access logs, and system monitoring to safeguard the confidentiality and security of all member information.

In addition, due to the inherent nature of the Internet and related technology, we do not guarantee the protection of information under our control against loss, misuse or alteration.

Data Transfer

Your information may be stored and processed in any country in which monoforest and Chat maintains facilities, including outside of the South Korea. In this regard, or for purposes of sharing or disclosing data as described in this Privacy Policy, monoforest and Chat reserves the right to transfer information outside of your country. By using the Service, you consent to any such transfer of information outside of your country.

Age

The Service is not directed to children under the age of thirteen (13) and we do not knowingly collect personally identifiable information from children under the age of thirteen as part of the Service. If we become aware that we have inadvertently received personally identifiable information from a user under the age of thirteen as part of the Service, we will delete such information from our records. If we change our practices in the future, we will obtain prior, verifiable parental consent before collecting any personally identifiable information from children under the age of thirteen as part of the Service.

Notification of Changes

We reserve the right at our discretion to make changes to this Privacy Policy. You may review updates to our Privacy Policy at any time via links on our website. You agree to accept electronic communications and/or postings of a revised Privacy Policy on the monoforest and Chat app, and you agree that such electronic communications or postings constitute notice to you of the Privacy Policy.
